Within England and Wales, the control of waste management activities is exercised through the Environmental Permitting (England and Wales) Regulations 2010 and subsequent amendments.

Under these Regulations, those activities with the greatest potential to cause environmental harm are identified within Schedule 1, while those activities that are exempt from the need for a permit are identified in Schedule 3.

The Regulations also identify the powers of the regulator (The Environment Agency) in relation to matters such as the revocation and suspension of permits, as well as identifying the offences for permit breaches.
